This summary is for orientation only; the following terms apply in full.

1. Scope and provider

These Terms of Service govern your use of the futcup app and the website www.futcup.app (together “futcup”). futcup is provided by Emre Dirlik, Eichhorster Weg 29, 13435 Berlin, Germany, support@futcup.app (“we”, “us”). Conflicting terms of users do not apply.

2. Contract and language

The contract for using futcup is concluded when you complete the registration and accept these terms. These terms also apply, where relevant, to the guest session during onboarding. The terms are available in German and English; the contract language is the language in which they are displayed to you. The current version is always available in the app and on our website; we will send you earlier versions on request.

3. Eligibility and minors

• You must be at least 16 years old to use futcup.
• If you are under 18, you may only purchase paid features with the consent of your parent or legal guardian, or with money given to you for that purpose (§ 110 BGB).
• Each person may have only one account. Accounts are personal and non-transferable, and must not be created by automated means.

4. Your account

Please provide accurate registration details, keep your password confidential and tell us immediately if you suspect misuse. You are responsible for activities carried out through your account unless you are not at fault. You can delete your account at any time in the app (Profile → Data & Privacy → Delete account); deletion is permanent.

5. The service

futcup is a football prediction game: you predict match results, earn points according to the scoring rules shown in the app, and compete on leaderboards, with friends and in groups. The basic service is free. We may offer optional paid features; their scope and price are shown to you before purchase. Beyond what is described here and in the app, there is no entitlement to specific features; your statutory rights under section 13 remain unaffected.

6. No monetary prizes

futcup is a game of skill for entertainment. There are no money prizes or prizes of monetary value. Points, ranks, trophies, badges and other virtual items have no monetary value, cannot be paid out, exchanged, sold or transferred to other users, and cannot be redeemed for money, goods or services.

You may not use futcup or groups to collect or distribute money among participants.

7. Rules of conduct

The following is not allowed:

• Usernames, display names or group names that are offensive, discriminatory, sexual, glorify violence, are misleading (e.g. impersonating others or futcup) or infringe the rights of others (e.g. trademarks)
• Automated access (bots, scripts, scraping), multiple accounts, or manipulating scoring or leaderboards
• Exploiting bugs or security vulnerabilities (please report them to us instead) attacking our systems or circumventing technical restrictions
• Harassing or spamming other users, e.g. with friend requests or invitations
• Commercial use of futcup without our consent

Depending on the severity of a violation, we may remove content, replace a username with a neutral one, restrict features, temporarily suspend the account or, in the case of serious or repeated violations, terminate the contract (section 17). In doing so, we take the legitimate interests of everyone involved into account and inform you of the reasons (section 15).

8. Your content

Content you create (such as your username, display name and group names) remains yours. You grant us a non-exclusive, free-of-charge, worldwide right to store, display and technically process this content, limited to what is needed to operate futcup (e.g. showing your username on leaderboards). This right ends when you delete the content or your account, unless we are legally required to keep it. You confirm that you hold the necessary rights to your content.

9. Groups and group leaders

Whoever creates a group is its leader. The leader can invite members and decide whether members see each other’s predictions before kick-off, and is responsible for ensuring that the group name is lawful. If the leader deletes their account, leadership passes automatically to the member who has been registered the longest; empty groups are deleted. We may rename or remove groups that violate these terms.

10. Scoring, match data and corrections

Fixtures, kick-off times and results come from third-party providers (currently football-data.org). We process them with care but cannot guarantee that they are always complete, up to date and correct.

If match data changes or is corrected (e.g. a rescheduled or abandoned match, or a corrected result), we may recalculate points and ranks or void affected predictions. Predictions can be submitted and changed until the deadline shown in the app, usually kick-off; the time on our server is decisive. We may adjust the scoring rules for future matches and competitions, but not retroactively for matches already played.

11. Virtual items

If futcup offers virtual items (e.g. trophies or badges), you receive a non-exclusive, non-transferable right to use them within futcup for the duration of the contract. Virtual items lapse when your account is deleted. Section 6 applies accordingly.

12. Purchases, subscriptions and right of withdrawal

• Paid features are purchased via the App Store (Apple). Payment is governed by Apple’s terms; prices including VAT are shown in the store before purchase.
• Subscriptions renew automatically for the same period unless you cancel them in your App Store subscription settings before the end of the current period. Deleting your futcup account does not cancel a store subscription.
• Right of withdrawal: consumers in the EU have a statutory 14-day right of withdrawal for digital content and services. For digital content provided immediately (e.g. virtual items), the right of withdrawal expires once delivery has begun if you have expressly agreed to immediate delivery and acknowledged that you thereby lose your right of withdrawal (§ 356(5) BGB). Details and the refund process are provided by Apple during the purchase. Your statutory rights remain unaffected.

13. Statutory warranty and updates

The statutory warranty rights for digital products apply (§§ 327 et seq. BGB). During the period of provision we provide the updates, in particular security updates, that are necessary to keep futcup in conformity with the contract. Please install updates promptly; we are not liable for defects that result solely from not installing an update that we provided together with information about the consequences of not installing it (§ 327f(2) BGB).

14. Availability and changes to the service

We aim for high availability. Maintenance, technical faults or outages at third parties (e.g. hosting or match data providers) may cause interruptions.

We further develop futcup and may change features where there is a valid reason (e.g. technical, legal or security requirements, or improvements to the game) and the change is reasonable for you. If a change to a paid feature impairs your access or use more than insignificantly, we will inform you in good time, and you may terminate the contract free of charge within 30 days (§ 327r BGB).

15. Reporting content and moderation

Our single point of contact for users and authorities under Art. 11 and 12 of the Digital Services Act is support@futcup.app (German or English).

You can report illegal content or violations of these terms (e.g. an offensive username) by email. Please describe as precisely as possible where the content is and why you think it is illegal or violates these terms. We review reports promptly, carefully and objectively and inform you of our decision.

We review content manually and do not use automated moderation. If we restrict content or an account, we inform the affected user and state the reasons (Art. 17 DSA), unless legal reasons prevent this. You can object to our decision by email; we will review it again.

16. Intellectual property and trademarks

The futcup app and website, including design, texts, logos and software, are protected by law. For the duration of the contract you receive a non-exclusive, non-transferable right to use futcup for private, non-commercial purposes. Decompiling or modifying the app is not permitted except as allowed by law (§§ 69d, 69e UrhG).

futcup is an independent project and is not affiliated with FIFA, UEFA, any league or club. Names of teams and competitions are used only to identify matches; all trademarks belong to their respective owners.

17. Term and termination

• The contract runs for an indefinite period. You can terminate it at any time by deleting your account. Store subscriptions must be cancelled separately (section 12).
• We can terminate the contract with 30 days’ notice by email or in the app. If you have an active subscription, termination takes effect no earlier than the end of the paid period.
• Both parties may terminate for good cause without notice (§ 314 BGB), in particular in the case of serious or repeated violations of sections 6 or 7; as a rule, we will warn you first.
• After the contract ends, your data is deleted as described in the Privacy Policy. You can download your data beforehand in the app.

18. Liability

We are liable without limitation for intent and gross negligence, for injury to life, body or health, under the German Product Liability Act and where we have given a guarantee.

In the case of slight negligence, we are only liable for breaches of essential contractual obligations (obligations whose fulfilment makes the proper performance of the contract possible in the first place and on whose fulfilment you may regularly rely) and limited to the foreseeable damage typical for this type of contract. Otherwise, our liability for slight negligence is excluded.

These limitations also apply to our vicarious agents. Your statutory warranty rights (section 13) remain unaffected.

19. Changes to these terms

We may amend these terms for a valid reason, e.g. changes in the law or case law, new features, or to close gaps in the rules. We will inform you of changes in the app in good time and ask for your express consent; changes only apply to you once you have accepted them. If you do not accept, you can tell us by email or delete your account; until the contract ends, the previous version continues to apply. We may then terminate the contract in accordance with section 17.

20. Dispute resolution and governing law

German law applies, excluding the UN Convention on Contracts for the International Sale of Goods. If you are a consumer habitually resident in another country, the mandatory consumer protection provisions of that country remain unaffected.

We are neither willing nor obliged to participate in dispute resolution proceedings before a consumer arbitration board (§ 36 VSBG).

Should individual provisions of these terms be invalid, the remaining provisions remain effective; the statutory provisions apply in place of the invalid ones.
